SA Best leader Nick Xenophon will sue Opposition Leader Steven Marshall (left).

SA-Best leader Nick Xenophon has taken the first steps in legal action against Opposition Leader Steven Marshall.

Mr Xenophon is threatening to take Mr Marshall to court over comments he made earlier this week that SA-Best had done a deal with Labor to target opposition-held seats to prevent a Liberal majority government in the upcoming South Australian election.

"Accordingly this morning I have issued a concerns notice to Mr Marshall, pursuant to the Defamation Act," Mr Xenophon said in a statement.
